WIRELESS TELEGRAPHY ACT

 

NOTICE OF VARIATION OF AMATEUR RADIO LICENCE (A) OR (A/B) OR (B)

 

The Secretary of State hereby gives notice pursuant to section 1 (14) of the Wireless Telegraphy Act 1949 to holders of the Amateur Radio Licence (A) or (A/B) or (B) (“the licence”) that, in effect from 1 October 2001, each Licence shall be varied as follows:

 

1.                 In this notice, “the Booklet” means the Terms, Provisions and Limitations Booklet BR68, the terms of which form part of the Licence.

 

2.                 As from 1 October 2001, the Licence shall be read and construed as if:

 

(1)              the heading of the Booklet were deleted and replaced by “ Amateur Radio Licence (A) or (B) Terms, Provisions and Limitations Booklet BR68”;

 

(2)              the words “ These terms, provisions and limitations shall be read as an integral part of the Amateur Radio Licence (A) or (B)” were deleted and replaced by the words “ These terms, provisions and limitations shall be read as an integral part of the Amateur Radio Licence (A) or (B)”;

 

(3)              a new sub-clause 1(9) were inserted in the Booklet:

 

        Having regard to sub-clauses 2(1) and 3(3), messages may be sent to non-licensed persons who are on a registered foundation or Intermediate training Course:

 

(a) it is under the direct supervision of the licensee or other Authorised Club Member (in case of a Licence held on behalf of a club), who must operate the transmitter and identify the station.”

 

(4)              sub-clause 1(9) were re-numbered “1(10)”;

 

(5)              sub-clause 1(10) were re-numbered “1(11)”;

 

(6)              sub-clause 1(11) were re-numbered “1(12)”;

 

(7)              sub-clause 1(12) were re-numbered “1(13)”;

 

(8)              sub-clause 1(13) were re-numbered “1(14)”;

 

 

(9)              sub-clause 2(1A) of the Booklet were deleted;

 

(10)         the words “In the case of an Amateur Radio Licence (A/B), authorise any club member who holds an Amateur Radio Licence (A/B) or (A) to use and supervise the operation of the Station on his behalf under this licence  “ were deleted from sub-clause 2(10)(a) of the Booklet;

 

(11)         the word “twelve” were deleted from sub-clause 3(1)(b) and replaced by the word “five”;

 

(12)         sub-clause 3(1)(c) of the Booklet were deleted;

 

(13)         sub-clause 3(1)(d) of the Booklet were renamed 3(1)(c);

 

(14)         sub-clause 5(4) of the Booklet were deleted;

 

(15)         sub-clause 5(5) of the Booklet were renumbered 5(4);

 

(16)         the following words were inserted to the end of sub-clause 6(3)(b) of the Booklet:

 

“Where the Log is maintained on a magnetic tape, disc or other electronic storage medium, suitable precautions should be taken to ensure that the log is backed up.”;

 

(17)         sub-clause 6(4) of the Booklet were deleted and replaced  by a new sub-clause 6(4):

 

“The Licensee shall keep the log for inspection by a person authorised by the Secretary of State for at least six months from the date of the last entry whether or not this Licence has expired or been revoked.”;

 

(18)         sub-clause 9(5) of the Booklet were deleted;

 

(19)         the word “(A/B)” in sub-clause 11(1)(e) of the Booklet were deleted;

 

(20)         the word “(A/B)” in the schedule to Terms, Provisions and Limitations

 Booklet BR68 were deleted;

 

(21)         the words “Post Office Customer Management” were deleted from Note (a) of the Booklet;

 

(22)         the words “or (A/B)” were deleted from Note (f) of the Booklet; and

 

(23)    a new sub clause (Z)(bb) were inserted in the Notes:

 

“When operating in accordance with 1(9) a registered training course is course recognised by on behalf of the Radiocommunications Agency.”; and

 

(24)    the email address were deleted and replaced by “amateurcb@ra.gsi.gov.uk”;
